County Executive Bob Tucker's June Letter to School Board

Below is the letter from Bob Tucker (Albemarle County, County Executive) dated June 27th providing his response to Chuck Ward's inquiry, on behalf of the School Board, to obtain information related to the Faulconer Construction Company's plans to build near Murray Elementary.

RE:  Response to June 19th Letter

Dear Dr. Ward:

Thank you for your inquiry concerning questions that have been raised by constituents regarding Faulconer Construction Company's proposed project on Morgantown Road near Murray Elementary School. Listed below is information regarding each of your questions that has been solicited from various Development Departments in the County.

bulletIs the proposal fully consistent with the current zoning regulations for this area?

The property is located in an area that is zoned "Light Industrial" which permits the use of the property for a contractor's office and equipment storage yard. Faulconer Construction Company's proposed use for that property is consistent with the zoning in that area.

However, to meet full compliance with the zoning regulations and other applicable ordinances, Faulconer Construction Company is required to obtain the Planning Commission's approval of a "site plan" which outlines specific details regarding their facility. Full compliance with regulations and applicable ordinances will not be confirmed until this site plan is approved. 

Faulconer Construction Company has submitted an initial site plan, however, the company requested that the County suspends review of the project pending re-design of the site plan. 

bulletWould well water quality in the area be impacted by this project?

The County does not conduct a specific review concerning well water quality per se.  However, there are legal requirements that must be met which are intended to help ensure protection of surface water quality, which may also benefit well water quality in the area.  Faulconer Construction Company will be required to obtain a(n):

  1. Health Department approval of drainfield locations and designs, which includes provisions for groundwater protection.
  2. Approved Stormwater Plan for surface runoff during and after construction.
  3. Certified Engineer’s Report from the Engineering Plan regarding the performance factors specified in the County Code §18.4.14.8, including the onsite treatment methods and mechanisms for controlling the discharge of products/byproducts of the proposed development.
  4. Approved Site Plan, which includes a plan for minimal impacts to the stream buffers, further protecting surface water quality. 
bulletWhat could the County do to alleviate the traffic concerns relative to Murray Elementary School that could result from the project?

As part of the site plan review process, County and Virginia Department of Transportation (VDOT) staff will review the entrance directly at the facility’s point of access to Dettor Road (private street) to assure it meets all commercial entrance requirements.  The point of access to the public road (Morgantown Road) will also be reviewed to assure compliance with VDOT requirements. 

VDOT could consider restricting truck travel on secondary roads such as Morgantown Road, provided that, in addition to other required findings, a reasonable alternative route exists. It could not however, restrict all trucks going to or from this site.

bulletWhen can citizens from this area address the Planning Commission about their concerns?

The Planning Commission reviews site plans at regularly scheduled meetings.  Citizens can make comments concerning a specific site plan at the meetings that the plan is being reviewed. 

At this time Faulconer Construction Company has not resubmitted their revised site plan.  Once their site plan for the proposed land use is resubmitted, the County will schedule it to be reviewed by the Planning Commission.

The County will notify all abutting property owners by mail of the date of the Planning Commission’s site plan review for this project.   As an abutting property owner, the Albemarle County School Board will also receive a notice of the upcoming meeting.

In addition, citizens can provide written comments on the proposed application, by submitting their comments directly to Yadira Amarante, Planner, Department of Planning and Community Development, 401 McIntire Road, # 208, Charlottesville, Virginia 22902, or by e-mail at  yamarant@albemarle.org.  All written comments will be forwarded to the Planning Commission with the site plan review package for their consideration.
